Please read these terms carefully before using Fasdex. By using our apps, you agree to be bound by them.
Last updated: April 21, 2026These Terms of Use ("Terms") govern your access to and use of the Fasdex mobile applications (Customer App, Restaurant App, Rider App) and any related services provided by Fasdex ("we", "us", "our").
By downloading, installing, or using any Fasdex application, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated into these Terms by reference.
If you do not agree to these Terms, do not use our applications.

Fasdex is a technology platform that connects:
Fasdex acts as a technology intermediary. We are not a restaurant, food producer, or delivery company. Restaurants are independent businesses responsible for the food they prepare. Riders are independent contractors, not Fasdex employees.
The contract for the sale of food is directly between the customer and the restaurant. The contract for delivery is between the customer and the rider, facilitated through the Fasdex platform.
When you place an order through the Fasdex Customer App, you are making an offer to purchase from the restaurant. The order is confirmed when you receive an in-app confirmation. Fasdex facilitates the transaction but is not the seller of the food.
You are responsible for providing accurate delivery address information. We are not liable for failed or delayed deliveries caused by incorrect addresses you provide.
If you order alcohol or other age-restricted items, you confirm that you are of legal drinking age in Nigeria (18+). The rider may request photo ID upon delivery and reserves the right to refuse delivery if you cannot verify your age.
You grant Fasdex permission to access your device location to display nearby restaurants and auto-fill your delivery address. You can withdraw this permission at any time in your device settings, though this may limit app functionality.
Restaurant partners must complete Fasdex's onboarding process, which includes identity and business verification. Fasdex reserves the right to approve or decline any restaurant application at its sole discretion.
You are solely responsible for:
Fasdex is not liable for any food safety incidents arising from food you prepare.
You are expected to accept or reject incoming orders promptly. Repeated failure to fulfil accepted orders, unexplained cancellations, or extended periods of being offline during listed operating hours may result in suspension of your account.
Fasdex charges a commission on each completed order as agreed in your onboarding agreement. Payouts of your earnings (net of commission and any applicable fees) are made to your registered bank account according to the payout schedule communicated at onboarding. Payout schedules may be updated with 30 days' notice.
You may not list on Fasdex:
Violation of this clause will result in immediate account suspension and may be referred to relevant authorities.
By uploading photos, descriptions, and menu content to Fasdex, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content within the Fasdex platform for the purpose of promoting your restaurant and products to customers.
You are an independent contractor, not an employee of Fasdex. Nothing in these Terms creates an employment relationship, partnership, or agency between you and Fasdex. You are responsible for your own tax obligations and are not entitled to employee benefits.
To register as a Fasdex rider you must:
When you activate an active shift in the Rider App, you consent to Fasdex collecting your precise GPS location in real time. This location is used to match you with nearby orders and to show customers live delivery tracking. Location tracking automatically stops when you end your shift or close the app. A persistent notification will be displayed on your device at all times when background tracking is active.
You can revoke location permission at any time through your device settings; however, doing so will prevent you from going online for deliveries.
The Rider App uses a floating overlay feature ("offer overlay") to display incoming delivery offers on your screen, even when you are in other apps. This feature requires the "Display over other apps" (SYSTEM_ALERT_WINDOW) permission on Android. You grant this permission voluntarily during onboarding. You may revoke it at any time from Android Settings → Apps → Fasdex Rider → Display over other apps.

Your earnings are calculated based on the delivery fee for each completed order, as shown in the app. Payouts are made to your registered bank account on the schedule communicated in the app. Fasdex may deduct amounts for disputed deliveries, platform fees, or other charges as set out in the Rider Earnings Policy available in the app.

You may not share your account with, or transfer your account to, another person. Each account is for a single individual or business entity.
We reserve the right to suspend or terminate accounts suspected of fraudulent activity, without prior notice where necessary to protect the platform.
Payments for food orders are processed via Paystack. By making a payment, you agree to Paystack's Terms of Service. Fasdex is not responsible for payment failures caused by your bank, card issuer, or Paystack.
Prices displayed in the app include VAT where applicable. A delivery fee and service charge apply to each order and are shown clearly before you confirm your order.
Fasdex does not charge additional fees for using particular payment methods. The price you see is the price you pay (excluding payment failures or declined transactions by your bank).
If an item is priced incorrectly due to a technical error, we reserve the right to cancel the order and issue a full refund, notifying you promptly.
A platform service charge is applied to each order. The current service charge amount is displayed in the app at the time of ordering. Fasdex reserves the right to adjust service charges with reasonable notice.

Violations may result in immediate account termination and, where appropriate, referral to law enforcement.
All content, features, and functionality of the Fasdex platform — including the name "Fasdex", logos, app design, code, and text — are the exclusive property of Fasdex and are protected by Nigerian and international copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Fasdex apps for their intended purpose. This licence does not include the right to:
Content you submit (such as reviews or profile photos) remains yours. By submitting it, you grant Fasdex a non-exclusive, royalty-free licence to use it for platform operations.
To the maximum extent permitted by applicable law:
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable Nigerian law.
The Fasdex platform is provided on an "as is" and "as available" basis, without warranty of any kind, either express or implied, including but not limited to:
We do not warrant that the platform will be free of viruses or other harmful components (though we take reasonable steps to prevent this).
Estimated delivery times shown in the app are estimates only and may vary due to traffic, weather, demand, or other factors. We are not liable for delivery delays.
You may delete your account at any time from within the app settings or by contacting support@fasdex.ng. Deletion takes effect within 7 days. Some data may be retained as required by law (see our Privacy Policy).
We may suspend or terminate your access to Fasdex at any time, with or without cause, and with or without notice, where we reasonably believe you have violated these Terms, engaged in fraud, or where required by law. We will endeavour to give reasonable prior notice except in cases of serious or urgent violations.
Upon termination, your licence to use the Fasdex apps ceases immediately. Any outstanding earnings owed to restaurant partners or riders will be paid out in accordance with the normal payout schedule after verifying there are no disputes. Any outstanding orders placed before termination will be fulfilled or refunded.
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
Before initiating any formal dispute process, you agree to first contact Fasdex at support@fasdex.ng and give us 30 days to attempt informal resolution of the dispute.
If informal resolution fails, disputes shall be subject to the exclusive jurisdiction of the courts of Nigeria. You waive any right to a class-action proceeding, and any claim must be brought in an individual capacity.
